Every Haute Vintage purchase comes with a full money-back guarantee. We take authentication seriously and hold our products to the highest standards. In the unlikely event your piece is found to be inauthentic, we will refund 100% of the original purchase price as per our Claims Process below.
GUARANTEE SUMMARY
The Guarantee applies to the creator of the item purchased, specifically, the identity of the specific creator, brand, or designer as stated in our marketing of the item and/or as indicated on the item’s Certificate of Authenticity issued by a third-party appraisal institution.
The Guarantee offered by Haute Vintage is to the original purchaser for the designer/brand name identified only. Any claim must be presented together with expert evidence that the named designer/brand is not as warranted within 60 days of the auction or sale. Upon claim approval, the item must be returned in the same condition as sold with all accoutrements and tags intact and the sole remedy is a refund of the purchase price less shipping and handling charges. PRODUCT DESCRIPTIONS
We attempt to provide accurate descriptions when we preview the items at auction, and we assign each item an overall condition rating as per our Condition Standards. Due to the pre-owned nature of our pieces, the product description may not be exact or all-inclusive and is intended to give a general description of the item based on physical observations and any history included when acquired. Notwithstanding the foregoing, we do not warrant that the product descriptions, condition reports, images or other information provided are accurate, complete, precise, reliable, current, or error-free.
PRODUCT REVIEW
As with any auction, you are buying the item at face value, thus, we strongly recommend viewing the product carefully during the auction preview and asking any questions before bidding. It is your responsibility to review and understand all of the information provided about a product, including the condition rating, before bidding. You acknowledge that the products are sold on an “AS-IS” basis.
AUTHENTICATION DATA
The third-party authentication provided is not based upon data provided by any brand and does not represent the opinion of any brand named directly or indirectly and should not be treated as such. The designers/brands are not bound by the authenticator’s findings and may not honor the certificate of authenticity that may accompany the item.
MISCELLANEOUS
Statements by Haute Vintage regarding the condition of items are for guidance only and should not be relied upon as statements of fact, and do not constitute a representation, warranty, or assumption of liability by Haute Vintage. All items offered are sold “AS IS”. The Guaranty does not apply to any physical attributes of the item and there are no returns, exchanges, or refunds. The Authenticity Guarantee is provided solely for the benefit of the Buyer and cannot be transferred to any third party.
Claims Process
To claim under the Authenticity Guarantee, the Buyer must:

Notify us in writing within 60 days of purchase that the Buyer received information that brings into question the brand authenticity of the Lot.

Obtain at the Buyer’s cost, and provide to us, the reports of two independent and recognized experts in the field who are mutually acceptable to us and the Buyer. We will not be bound by any such reports, and we reserve the right to seek additional expert advice at our expense.

Upon claim approval, return the Lot to us in the same condition, and with all accoutrements and tags intact, as at the date of sale to the Buyer and be able to transfer good title in the Lot, free from any third-party interest or claim(s) arising after the date of the sale.

We reserve, in our absolute discretion as principal, the right to reject a claim under the Authenticity Guarantee if:

the identified brand description was in accordance with the opinions of industry experts that are generally accepted and known or privately expressed to us, as at the date of the sale; or the Lot description indicated there was a conflict of such opinions;

the only method of establishing that the Lot was a counterfeit at the date of the sale would have been by means or processes not then generally available or accepted, unreasonably expensive or impractical to use, or likely to have caused damage or loss of value to the Lot;

the manner in which the Lot is said to be a counterfeit is due only to damage, restoration, modification work of any kind (including repainting or over-painting), treatment of hardware or gemstones, or damages to labels present at the time of the sale, or the inability of the manufacturer, maker or relevant archives to confirm the authenticity of the Lot; or
-
the manner in which the description of the Lot is incorrect does not result in a material loss in value of the Lot.

Subject to the above, if we reasonably determine that the Lot is a counterfeit, we will ensure that the sale is rescinded, and that the Buyer is refunded the Purchase Price in the currency of the sale, less shipping and handling charges.

It is specifically understood and agreed that the rescission of the sale and the refund of the Purchase Price is the Buyer’s sole remedy available under the Authenticity Guarantee and is in lieu of any other remedy that might otherwise be available to the Buyer as a matter of law or in equity. Haute Vintage shall not be liable for any special, punitive, incidental or consequential damages incurred or claimed, including without limitation, loss of profits or interest.
